1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of RallyRoom, including the RallyRoom website and account hub, Rally-branded product applications, related subdomains, communications, and services that link to these Terms (collectively, the “Service”).

By creating an account, purchasing a subscription or product license, creating or managing an organization or game, joining a game, uploading content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, company, school, club, team, event, stream, community, or other group, you represent that you have authority to bind that organization or group to these Terms. In that case, “you” includes both you personally and the organization or group you represent.

2. Who operates RallyRoom

RallyRoom is operated by CrackShot Games, an Ohio limited liability company.

3. What RallyRoom is

RallyRoom is a SaaS platform for lightweight group games and engagement experiences. RallyRoom may be used by offices, teams, streams, live events, communities, clubs, classrooms, friend groups, and similar groups. RallyRoom includes a central account, organization, billing, product-access, and launch hub, together with Rally-branded product apps such as RallyBingo, RallyBracket, RallyRank, RallyCanvas, and future products.

RallyRoom account holders and organization administrators create and manage games. Public participants may join particular games through game links or codes without creating full RallyRoom accounts unless a specific product feature says otherwise.

4. Definitions

  • “Account User” means a person who creates or uses a RallyRoom account.
  • “Organization” or “Workspace” means a group, team, company, school, club, event, stream, community, or other unit created or managed in RallyRoom.
  • “Owner” or “Admin” means an Account User with permission to create, configure, manage, or administer an Organization or game.
  • “Participant” or “Player” means a person who joins or participates in a RallyRoom-powered game, whether or not that person has a RallyRoom account.
  • “Customer Content” means content, data, images, GIFs, text, prompts, templates, game items, names, logos, entries, uploads, drawings, responses, or other materials submitted, uploaded, configured, or generated by Account Users, Organizations, Admins, Players, or Participants through the Service.
  • “RallyRoom Content” means software, designs, templates, text, graphics, features, workflows, documentation, branding, and other materials provided by RallyRoom or CrackShot Games, excluding Customer Content.

5. Account eligibility and responsibilities

RallyRoom accounts are intended for organizers, administrators, and authorized users, not for children to create their own accounts. By creating a RallyRoom account, you represent that you are at least 18 years old or otherwise authorized to create and manage the account on behalf of your organization or group.

You agree to provide accurate account information, maintain the security of your login credentials, and promptly notify us if you believe your account has been compromised. You are responsible for activity that occurs under your account, organization, or admin credentials, except to the extent caused by RallyRoom's own breach of these Terms or applicable law.

You may not share admin credentials in a way that bypasses RallyRoom's access controls or permits unauthorized users to manage an Organization or game.

6. Organizations, admins, and game control

Organization Owners and Admins control many aspects of their Organization and games, including game setup, participant links, email collection settings where supported, uploaded content, templates, game rules, visibility, and deletion of games or participant data. Organization Owners and Admins are responsible for using these controls lawfully and appropriately for their group.

If you create or manage a game, you are responsible for deciding what information is appropriate to collect from participants, for sharing game links responsibly, and for ensuring that your use of RallyRoom complies with your organization's own rules, employment policies, school policies, privacy notices, event rules, or other obligations that may apply to you.

7. Public participants and player join flows

Participants may join a game by providing information requested by the game, such as a name, display information, or optional email address where email collection is enabled. Participants should use the name or identifier their organizer asked them to use. For classrooms, youth groups, or privacy-sensitive groups, organizers should avoid collecting full legal names, email addresses, images, GIFs, or other personal information unless appropriate and authorized.

RallyRoom uses participant information to operate the game experience, maintain participation records, show game progress or results, support participant return flows, and provide game-related features selected by the organizer. Participant information may be visible to the Organization's authorized admins and may be deleted by admins through available product controls.

8. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. The Privacy Policy is incorporated into these Terms by reference. By using the Service, you acknowledge that information will be handled as described in the Privacy Policy.

If you use RallyRoom to collect information from participants, you are responsible for providing any additional notices or consents required by your organization, school, event, community, or applicable law.

9. Children, classrooms, schools, and youth groups

RallyRoom is a general-audience service and is not directed to children under 13. RallyRoom accounts are intended for organizers, administrators, and authorized users, not for children to create their own accounts.

If you use RallyRoom with children, students, classrooms, schools, youth groups, camps, clubs, or similar groups, you represent that you have appropriate authority to do so and that you will configure the Service in a privacy-protective way. This includes avoiding unnecessary collection of full legal names, email addresses, images, GIFs, or other personal information from children or students unless you have appropriate authorization.

If a school or authorized educator uses RallyRoom for a school-authorized educational purpose, the school or educator is responsible for ensuring that the use is permitted by school policy and applicable law. RallyRoom will use participant information submitted through the Service to provide the requested game functionality and related operational support, and not to sell personal information or engage in behavioral advertising.

If we learn that personal information has been collected from a child under 13 in a way that requires deletion under applicable law, we will take appropriate steps to delete it. Parents, guardians, schools, organizers, or participants may contact us regarding deletion requests, and we may also coordinate with the Organization or organizer that created the game.

10. Email and communications

RallyRoom may send account, authentication, security, admin invitation, billing, service, and product-related communications. These may include email confirmation, password reset, magic-link login, workspace invitations, billing notices, service updates, support messages, and similar operational communications.

Some RallyRoom games may allow organizers to enable optional participant email collection for game-related communications. When enabled, game-related emails may include welcome messages, reminders, updates, results, or winner notifications. Organizers are responsible for using participant email features appropriately and only where they have authority to contact those participants.

You may not use RallyRoom email features to send unlawful, misleading, harassing, abusive, or unauthorized messages. You may not use game-operational email features as a workaround for unsolicited marketing. Promotional or marketing emails must comply with applicable email laws and must not be disguised as game-operational messages.

11. Subscriptions, purchases, and billing

RallyRoom may offer free access, trials, subscriptions, one-time product licenses, workspace upgrades, promotions, or other paid and unpaid access models. Available plans, prices, limits, and features may be described on RallyRoom's pricing pages, checkout pages, billing pages, or product documentation.

Payments are processed by third-party payment providers such as Stripe. By purchasing a paid plan or product license, you authorize RallyRoom and its payment providers to charge the applicable payment method for the selected purchase, subscription, taxes, and any other amounts disclosed at checkout.

Subscriptions renew automatically until canceled unless the checkout flow or plan terms state otherwise. You are responsible for canceling before renewal if you do not want the subscription to renew. Cancellation will take effect according to the plan terms shown in the billing flow, which may include access through the end of the then-current billing period.

We may change plan prices or features from time to time. If a change materially affects an existing paid subscription, we will provide notice where required or appropriate. Continued use after the effective date of a change may require acceptance of the new price or terms.

12. Permanent product licenses and one-time purchases

RallyRoom may offer one-time “Permanent Product License” purchases for individual Rally products. A Permanent Product License means that the purchasing Organization receives a non-transferable, organization-scoped entitlement to access the specified product without a recurring subscription fee for that product, subject to these Terms, applicable product limits, and the continued operation and availability of the hosted Service.

A Permanent Product License is not a promise that RallyRoom, any product, any feature, any hosting environment, or any third-party service will operate forever. We may modify, discontinue, replace, suspend, or retire products or features as described in these Terms. If we materially discontinue a product for which active Permanent Product Licenses were sold, we will use reasonable efforts to provide a fair transition, replacement, credit, export, refund, or other remedy where appropriate, but no remedy is guaranteed except where required by law or expressly stated in writing.

Permanent Product Licenses do not unlock other Rally products unless explicitly stated. They do not necessarily include organization branding, admin-capacity upgrades, premium suite features, support tiers, or other platform-level features unless those benefits are expressly included in the purchase description.

13. Refunds and cancellations

Unless otherwise stated at checkout or required by law, fees are non-refundable. We may, in our discretion, provide refunds, credits, or other accommodations where we believe they are appropriate. If you believe a charge was made in error, contact us promptly at crackshotgamestudios@gmail.com.

Cancellation of a subscription stops future renewal charges but does not automatically refund past charges. If your access continues until the end of a billing period, your account may remain active until that period ends.

14. Customer Content and Ownership

As between you and RallyRoom, you retain ownership of Customer Content you submit, upload, configure, or provide through the Service, subject to any rights held by your organization, school, employer, event, or other applicable party. RallyRoom does not claim ownership of your Customer Content solely because you use the Service.

You grant RallyRoom and its service providers a worldwide, non-exclusive, royalty-free license to host, store, copy, display, transmit, process, modify for formatting or technical purposes, and otherwise use Customer Content as reasonably necessary to provide, secure, support, improve, and operate the Service, enforce these Terms, comply with law, and provide requested functionality.

You represent and warrant that you have the rights and permissions necessary to submit Customer Content and to grant the license above. You are responsible for Customer Content submitted through your account, Organization, game, or participant upload settings.

15. User-generated content, uploads, and moderation

RallyRoom products may allow admins and, where enabled by admins, participants to upload or submit images, GIFs, logos, text, prompts, tier-list items, alignment-chart items, drawings, game names, templates, responses, or other content. You may not upload or permit content that violates these Terms, violates law, infringes intellectual property or privacy rights, contains malware, reveals sensitive personal information without authorization, harasses or threatens others, exploits children, is sexually explicit involving minors, or is otherwise unsafe or abusive.

We may remove or disable access to Customer Content, suspend upload features, limit sharing, or suspend accounts or Organizations if we believe content violates these Terms, creates legal or security risk, or may harm RallyRoom, users, participants, or others. We do not undertake to review all content and are not responsible for content submitted by users or organizations.

If you enable participant uploads, you are responsible for deciding whether uploads are appropriate for your group, event, classroom, stream, or community and for moderating content where needed. For children, students, youth groups, or privacy-sensitive participants, you should avoid enabling uploads unless you have appropriate authorization and moderation expectations.

16. Acceptable Use

You agree not to use the Service to:

  • violate any law, regulation, contractual obligation, or third-party right;
  • infringe, misappropriate, or violate intellectual property, privacy, publicity, or other rights;
  • upload malware, malicious code, harmful files, or content designed to disrupt systems;
  • attempt to access accounts, organizations, games, data, systems, or networks without authorization;
  • bypass or interfere with authentication, authorization, entitlement, billing, plan limits, quotas, rate limits, or security controls;
  • harass, threaten, abuse, defame, impersonate, discriminate, or target others in a harmful way;
  • submit sexual content involving minors or content that exploits or endangers children;
  • collect personal information from participants in violation of applicable law or without appropriate authorization;
  • send spam, phishing messages, misleading emails, or unauthorized marketing through the Service;
  • scrape, crawl, reverse engineer, or extract data from the Service except as permitted by law or written permission;
  • resell, sublicense, rent, or commercially exploit the Service except through an authorized plan or written agreement;
  • misrepresent affiliation with RallyRoom, CrackShot Games, another organization, or any third party;
  • use the Service to build a competing product using non-public RallyRoom content, data, or functionality;

17. RallyRoom intellectual property

RallyRoom, CrackShot Games, RallyBingo, RallyBracket, RallyRank, RallyCanvas, RallyWager, related logos, product names, software, interfaces, templates, designs, text, documentation, and other RallyRoom Content are owned by CrackShot Games or its licensors and are protected by intellectual property and other laws.

Subject to your compliance with these Terms and payment of applicable fees, RallyRoom grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your organization's internal, event, community, stream, classroom, or group game purposes.

No rights are granted except as expressly stated in these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from RallyRoom Content except as allowed by the Service's normal functionality or with written permission.

18. Feedback

If you submit ideas, suggestions, bug reports, feature requests, or other feedback, you grant RallyRoom permission to use that feedback without restriction or compensation. You agree that we may use feedback to improve, modify, or develop products and services.

19. Third-party services

The Service may depend on or link to third-party services such as hosting providers, database providers, authentication providers, payment processors, email providers, OAuth providers, storage providers, or other integrations. Third-party services are governed by their own terms and policies. RallyRoom is not responsible for third-party services outside our control, but we will use reasonable efforts to choose appropriate providers for the Service.

20. Service changes, availability, and beta features

We may modify, update, suspend, limit, replace, or discontinue any part of the Service at any time. We may also release beta, experimental, preview, or early-access features that may be incomplete, unstable, or changed without notice.

We aim to keep the Service reliable, but we do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times. Maintenance, outages, third-party service failures, security events, abuse prevention, or other events may affect availability.

21. Data deletion, exports, and backups

Admins may be able to delete games, participant records, uploaded content, or Organization data through product controls. Deletion may not immediately remove data from backups, logs, audit records, billing records, or legal/security records, but we will use reasonable efforts to delete or de-identify data in accordance with the Privacy Policy and applicable law.

RallyRoom may offer export tools in some products but is not required to provide custom exports unless required by law or a separate written agreement.

22. Security

We use reasonable safeguards designed to protect the Service and information processed through it. You are responsible for using strong passwords, protecting your credentials, managing admin access, configuring games appropriately, and promptly notifying us of suspected unauthorized access or security issues.

You may not test, scan, probe, or attack RallyRoom systems except through an authorized security program or with prior written permission. If you discover a security issue, please report it responsibly to crackshotgamestudios@gmail.com.

23. Copyright complaints and DMCA process

If you believe content on the Service infringes your copyright, contact us at crackshotgamestudios@gmail.com with information sufficient for us to locate and evaluate the material. Your notice should include identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is not authorized, and a statement that the information is accurate and that you are authorized to act on behalf of the copyright owner.

RallyRoom may remove or disable access to allegedly infringing content and may terminate or restrict users or organizations that repeatedly infringe copyrights. If RallyRoom expands public user-generated content features, we may publish a more formal DMCA policy and designate an agent with the U.S. Copyright Office.

24. Suspension and termination

You may stop using the Service at any time. You may cancel paid subscriptions through the available billing or account-management tools or by contacting us if those tools are unavailable.

We may suspend or terminate accounts, Organizations, games, access, uploads, or features if we reasonably believe that you or your Organization violated these Terms, created legal or security risk, failed to pay amounts due, abused the Service, or used the Service in a way that may harm RallyRoom, other users, participants, or third parties.

Upon termination, your right to use the Service ends. Certain provisions of these Terms will survive termination, including provisions related to payment obligations, intellectual property, Customer Content licenses needed for legal/security purposes, disclaimers, limitations of liability, indemnification, dispute resolution, and any other terms that by their nature should survive.

25. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLYROOM AND CRACKSHOT GAMES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND ERROR-FREE OPERATION.

RallyRoom does not guarantee any particular engagement result, workplace outcome, educational outcome, event outcome, revenue outcome, availability level, data-retention period, or compatibility with every device, browser, email provider, organization policy, or third-party service.

26. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLYROOM, CRACKSHOT GAMES, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST GOODWILL, LOST DATA, SERVICE INTERRUPTION, OR SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLYROOM'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO RALLYROOM FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

27. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless RallyRoom, CrackShot Games, and their owners, officers, employees, contractors, service providers, and agents from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your use or misuse of the Service;
  • your Customer Content;
  • your Organization's games, participant communications, uploads, or settings;
  • your violation of these Terms or applicable law;
  • your infringement or alleged infringement of third-party rights;
  • your collection or use of participant, student, child, employee, or other personal information through the Service;
  • your unauthorized or improper use of email, uploads, public links, or admin features.

28. Governing law and venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Subject to any mandatory law that provides otherwise, the state and federal courts located in Ohio will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

29. Changes to these Terms

We may update these Terms from time to time. When we make changes, we will update the “Last Updated” date. If changes are material, we may provide additional notice by email, in-product notice, or other reasonable means. Your continued use of the Service after changes become effective means you accept the updated Terms.

30. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms presented in the Service, are the entire agreement between you and RallyRoom regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, but we may assign them in connection with a merger, acquisition, reorganization, sale of assets, or operation of law. We are not liable for delay or failure caused by events beyond our reasonable control.
